Welcome to the KINDLING AFRIKA (PTY) LTD website. By accessing or using our website and services, you agree to be bound by these terms.

1. Application

These terms apply to all purchases, browsing, and use of our website. This website is operated by KINDLING AFRIKA (PTY) LTD, registration number 2026/252981/07, with registered address at 22 PETER ROAD, ROODERPOORT, JOHANNESBURG, GAUTENG, South Africa.

2. Orders & Contracts

  • When you place an order and complete payment, you are making an offer to purchase goods from us. We will send you an order confirmation email, but a binding contract of sale only comes into effect when we dispatch your order and send you a shipping confirmation email.
  • We reserve the right to cancel orders for reasons including out of stock, pricing errors, or incorrect product information. If we cancel your order, you will receive a full refund.
  • You must be 18 years of age or older, or have parental/guardian consent, to make purchases on this website.

3. Pricing & Payment

  • All product prices are displayed in South African Rand (ZAR).
  • We accept South African payment methods including credit/debit cards, Instant EFT, Capitec Pay, Apple Pay, and Google Pay, processed by our licensed payment provider Peach Payments. We will reserve stock for your order once payment is successfully completed.
  • If payment fails, your order will be automatically cancelled and you may resubmit your order.

4. Delivery

  • We only deliver to addresses within South Africa. Full delivery details are outlined in our Shipping Policy.
  • Delivery times are estimates only. We are not liable for delays caused by force majeure events including courier strikes, natural disasters, or other circumstances outside of our control, but will assist you in tracking your delivery.
  • Risk of loss or damage to goods passes to you upon delivery and signature for the parcel. Ownership of goods passes to you once full payment is received and the parcel is delivered.

5. Limitation of Liability

  • We are only liable for defects in the goods themselves, and will not be liable for indirect, incidental, or consequential damages arising from use of the products.
  • Product images are for illustrative purposes only. Minor colour differences caused by monitor displays do not qualify as product defects.
  • We do not guarantee uninterrupted access to our website, and are not liable for temporary outages due to system maintenance.

6. Dispute Resolution

  • All disputes will first be resolved via good faith negotiation. If negotiation fails, disputes will be subject to the exclusive jurisdiction of the courts of Johannesburg, South Africa.
  • These terms are governed by the laws of the Republic of South Africa.

7. Updates to Terms

We reserve the right to update these terms at any time. Updated terms will be posted on this page, and your continued use of the website after changes are posted constitutes acceptance of the updated terms.
